The Board must review an order prior to its expiry, the Board can review an Order at the request of the person concerned, the guardian, the Director of Social Welfare or on its own initiative. Usually a review is held when there is a change in circumstances. For example, order not working for person under guardianship, circumstances have changed affecting order, or these being no further need for guardianship.
A review is not an appeal
When Guardianship Board conducts a review, it does not re-examine the original decision. When hearing a review matter, Guardianship Board considers the current circumstances of the person who is the subject of the order and decides whether the order should continue or whether it needs to be changed.
